Question 2 - Exclusive Buyout License

When a photographer uploads an image to Fotolia, they determine how the image will be sold. This is decided by answering four simple questions. This article discusses what an exclusive buyout license is as asked in question two.

Do you wish to sell an exclusive buyout license of your photograph with a more traditional license?

In question number one we asked if a photographer would grant exclusivity to Fotolia. In this question we ask if the photographer would like to sell the image as an exclusive buyout license to the buyer.

The exclusive buyout license is a special license with additional privileges than the standard royalty free license [Licenses Chart].


When a photographer sells an exclusive buyout license the buyer may use the image for :

  • Internet use – Websites, email, and other electronic forms of distribution
  • Print use – Magazine ads, brochures, direct mail, ect
  • Product resale- Cover image for a book, posters, calendars, coffee mugs ect.

In this model, the photographer agrees to sell the photograph for an exclusive buyout license. When the exclusive buy out license is sold to a buyer the photographer agrees to the following terms:


  • that the photograph is withdrawn from the Fotolia web site

  • the photographer will never sell the license or use the photograph again in a professional manner without penalty.

  • the customer will have the right to use the image for any commercial use including the sale of products with the photographers image such as tshirts, calendars, and posters.
  • the photographer acknowledges that no further compensation will be issued from Fotolia or the buyer as a result of buyer use of the image.

Photographers who sell their image as an exclusive buy out license may set the price from $100 - $2000. Photographers should determine the price of the image while considering the resolution of the image, esthetic quality, and commission as determined by the remuneration chart.
