What is an Exclusive Buyout License?
An "Exclusive Buyout" license is a unique royalty free license that provides the most image rights and privileges to buyers and the highest commissions to photographers.
This license extends the rights offered by our standard royalty free license, for example, upon purchase of this license the image may be used for commercial purposes such as selling the photo in a template, poster, postcard, or any other derived product.
Exclusivity
The “Exclusive Buyout” license offers an additional special feature of exclusivity. When the image is purchased with an Exclusive Buyout license Fotolia removes the image from the website and discontinues further sales thus allowing you to have the last purchase of the image.
It is possible that the image may have already been sold with our standard Royalty Free License or with another agency. This image could be used for non-commercial purposes such as a web or print illustration. However, a web and print license does not have the same rights and priviledges as the Exclusive Buyout license. Only those who purchase the Exclusive Buyout license may sell products with the image such as greeting cards, calendars, and posters. Fotolia guarantees that after the Exclusive Buyout license is sold no other license for this image will be sold.
In addition to the rights and privileges of the Standard Royalty Free License, the Exclusive Buyout license allows the following commercial uses:
- Postcard Sales
- Poster Sales
- Template Sales

I'll like to know if your Exclusive Buyout license or your Royalty Free, include ussage for TV advertising. I'm looking for images for a TV station promo as well as for some of our client's spots.

Hello Maria,
Yes the exclusive buyout license would allow you to use the image on a TV advertisement and for your clients spots. However your clients can not resell the image.

What kind of license do I need for using the pictures on the following application:
Background/templates of online sold calendars into which the buyer will add his own pictures. The calendar will be printed according to the buyers design in 1-10 copies. The template will be offered to all buyers but will never be used as a standalone picture. My use does not require exclusivity.

I am writing a teacher's guide on world history through time. It is a commercial product, but I only want to use an image or two to accompany original text on a page. This would amount to mayb 2 or 3 images in a 200 page book. May I use images in this manner under the standard royalty free license? I need to know this soon...I am on a deadline.
Posted by Katja on 00:26, May 15 2006
Yes you may use the exclusive buyout license to create and sell images on tshirts.

What type of license do I need to use your photos on a brochure that I am making for a Physical Therapy Clinic? The brochure will describe the clinics services. The brochure will not be sold and I am not getting paid to do this work. I would also like to use the photos on a web site that I am creating for the same clinic.

To create a brochure and illustrate a website I suggest using the L or XL standard license.

Hi,
If I'd like to resell the images, is it possible to do so? if yes, how can i buy the images rights to resell them?
Posted by Sanon S. on 03:20, June 29 2006
Sanon,
You can only resell products with the image on it such as a poster or greeting card if you have the exclusive buyout license of the extended rf license. Reselling the original image is not allowed.
